Service & Liability Disclaimer
Pool Lizards Pool Cleaning takes pride in providing professional and careful pool service. However, swimming pools, pool finishes, and pool equipment are complex systems, and problems may develop due to age, normal wear and tear, improper installation, pre-existing conditions, water chemistry history, electrical or plumbing issues, manufacturer defects, weather, or other circumstances outside of our control.
By using our services, the customer acknowledges and agrees that Pool Lizards Pool Cleaning is not responsible for pre-existing conditions, normal wear and tear, equipment failure, leaks, plumbing or electrical problems, structural damage, or deterioration of pool surfaces and finishes that is not directly caused by the negligent actions of Pool Lizards.
This includes, but is not limited to, plaster, pebble finishes, quartz finishes, tile, grout, coping, decking, painted surfaces, and other interior or exterior pool finishes.
The presence of a Pool Lizards technician on the property, or the discovery of a problem during or after a service visit, does not by itself mean that Pool Lizards caused the problem.
Pool Lizards is not responsible for damage or conditions resulting from:
-
Aging, worn, damaged, improperly installed, or previously repaired pool equipment
-
Pumps, filters, heaters, chlorinators, salt systems, valves, plumbing, electrical systems, automation systems, or other equipment failing during normal operation
-
Existing leaks, cracks, corrosion, deterioration, structural problems, or surface defects
-
Staining, discoloration, fading, etching, scaling, cracking, delamination, roughness, mottling, or other deterioration of plaster, pebble, quartz, tile, grout, coping, decking, or other pool finishes
-
Previous or long-term water chemistry conditions, including conditions that existed before Pool Lizards began servicing the pool
-
Loss of water, low water levels, or a customer's failure to maintain the proper pool water level
-
Equipment being turned off, breakers being tripped, loss of electricity, or inadequate circulation
-
Failure of the homeowner or another contractor to properly operate, maintain, repair, or replace equipment
-
Severe weather, freezing conditions, storms, power outages, flooding, excessive debris, or other conditions outside our control
-
Damage caused by pets, landscaping, construction, other contractors, homeowners, guests, tenants, or third parties
-
Conditions that could not reasonably be identified during routine weekly pool service
Weekly pool service is not a comprehensive inspection of the pool structure, pool finish, plumbing, electrical system, or equipment. Our technicians may notify customers when they observe a potential problem, but Pool Lizards does not guarantee that every equipment defect, leak, surface issue, safety concern, or developing condition will be discovered during routine service.
Customers are responsible for maintaining their pool, pool surfaces, and equipment in safe and working condition and for promptly completing recommended repairs when necessary.
If Pool Lizards believes that equipment, water conditions, pool surfaces, or property conditions prevent us from safely or properly servicing the pool, we reserve the right to limit service, provide chemical-only service, or suspend service until the issue has been corrected.
Pool Finish & Plaster Disclaimer
Pool plaster, pebble, quartz, tile, grout, coping, and other pool finishes naturally age and may change in appearance over time. This can include staining, discoloration, fading, mottling, scaling, etching, roughness, cracking, delamination, or other cosmetic or structural changes.
These conditions can be caused by many factors, including the age and condition of the finish, installation quality, previous water chemistry, source water, metals or minerals in the water, environmental conditions, equipment problems, circulation issues, and conditions that existed before Pool Lizards began servicing the pool.
Maintaining water chemistry within normal service ranges does not guarantee that an existing pool finish will remain unchanged or free from staining, discoloration, scaling, etching, deterioration, or other surface conditions.
Pool Lizards Pool Cleaning is not responsible for deterioration, staining, discoloration, damage, or changes to plaster or other pool finishes unless the condition was directly caused by negligent workmanship performed by Pool Lizards.
Routine pool service does not include inspection or certification of the condition, lifespan, installation quality, or structural integrity of the pool finish.
Pool Lizards will only be responsible for damage when it is determined that the damage was directly caused by our negligent workmanship. Pool Lizards is not responsible for unrelated, pre-existing, consequential, incidental, cosmetic, surface, or equipment damage.
